The General Terms and Conditions of Sale below are permanently accessible on the present site by the purchaser at the time the order is registered.

Prior to any order, the Customer declares :

9 - PROHIBITION OF OFF-NETWORK SALES :

CHRISTINE DARVIN products are intended to be sold exclusively through our distribution networks. Consequently, it is forbidden to sell, buy or receive gifts of our products for resale outside our networks, particularly on Internet sites. In addition to infringing our brands or the integrity of our products, such actions may give rise to civil and, where applicable, criminal liability on the part of the perpetrators.

10 - ACCESS TO THE SITE

The customer is personally responsible for setting up the IT and telecommunications resources required to access the www.parfums-christinedarvin.com website.

The customer is responsible for all telecommunication costs incurred in accessing and using the site.

11 - PRODUCT CHARACTERISTICS

Prices and commercial offers are limited to Metropolitan France (excluding Corsica, Monaco, Luxembourg and Belgium).

Products will be invoiced on the basis of the prices in force at the time the order is registered.

Product prices are indicated in euros and include VAT applicable on the day of invoicing, and correspond to actual selling prices.

Under no circumstances may the Customer take advantage of any other price charged for any other sales method.

The sale prices of Products may be modified by www.parfums-christinedarvin.com at any time. This modification will be indicated on the site before any order is placed.

Colissimo prices do not include shipping costs, which amount to :

- Depending on weight, between 0.250kgs and 3kgs, from €9.31 to €15.64 (inc. VAT) by Colissimo without signature in mainland France (including Corsica) and Monaco.

- Depending on weight between 0.250kgs and 3kgs rate from €10.74 to €17.08 incl. VAT by Colissimo with signature in Metropolitan France (including Corsica) and Monaco

DPD PREDICT prices exclude shipping costs, which amount to :

- Depending on weight between 1kgs and 3 kgs rate from €7.27 to €8.46 incl. VAT

DPD Relay prices exclude shipping costs, which amount to :

- Depending on weight between 1kgs and 3 kgs from €6.70 to €7.30 inc.

14 - ORDERING

Orders placed on www.parfums-christinedarvin.com on Friday afternoon, Saturday or Sunday will be processed on the following Monday.

Orders placed on the www.parfums-christinedarvin.com site on a public holiday other than Friday afternoon, Saturday or Sunday are also processed on the next working day.

Working days on the CHRISTINE DARVIN site run from Monday 9am to Friday 11.30am.

The different steps to follow to place an order are as follows:

The customer who wishes to place an order selects the product(s) of his/her choice by clicking on "add to basket".

At any time, the customer can :

- check the number of products in their basket and obtain detailed information on each one by clicking on the "My basket"/"view my basket" icon,

- continue shopping by clicking on the "Continue shopping" button,

- enter your delivery details

- complete your order by clicking on the "Complete my order" button.

The customer identifies himself (e-mail and password). New customers must create an account and identify themselves by entering a valid e-mail address and a password (personal and confidential), which they will use later to identify themselves on the site.

The customer chooses their delivery method, validates it, and then selects the payment method from among those proposed, which must be validated in turn.

The personal information required to process and deliver orders is mandatory. When the customer confirms his/her order after having accepted the general terms and conditions of sale, by clicking on the “I have completed my order” button, he/she declares that he/she accepts the order and the present general terms and conditions of sale in their entirety. The order is then processed by our customer service department. As soon as the order has been registered, a detailed acknowledgement of receipt will be sent to the customer's e-mail address. This acknowledgement summarizes all the elements making up the order, including the exact amount invoiced and delivery terms.

Subject to the right of withdrawal referred to in the following article 19, all orders shall become final once CHRISTINE DARVIN has sent the customer an e-mail confirming the order and has received full payment. CHRISTINE DARVIN recommends the customer to keep this information on a paper or computer document.

Any confirmation of the order form by double-clicking constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

CHRISTINE DARVIN reserves the right to refuse, suspend or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order or an order in progress, or for any other legitimate reason relating in particular to the abnormal nature of the order.

15 - PAYMENT

The amount to be paid is the total amount including VAT of the products ordered to which CHRISTINE DARVIN adds the delivery charges as determined in the general terms of sale in the article “Delivery”.

Payment for purchases on the site is exclusively in euros (€).

Payment can be made by credit card (CB, Visa, Mastercard) or paypal. Online payment is entirely secure. Customers make their purchases in total security.

Transactions carried out on www.parfums-christinedarvin.com are secured by the Ogone payment system (www.ogone.com). All information exchanged to process payment (16-digit card number, expiry date, visual cryptogram) is encrypted using SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. Nor is it stored on CHRISTINE DARVIN's computer systems.

Personal data is therefore never transmitted unencrypted on the Web and is not accessible to any intermediary.

By communicating his/her bank details, the customer accepts in advance and unconditionally that CHRISTINE DARVIN may proceed with the secure transaction. The customer therefore authorizes his bank in advance to debit his account on the basis of records or statements transmitted by CHRISTINE DARVIN, even in the absence of invoices signed by the cardholder.

Confirmation of the order form by the customer, by double-clicking, constitutes an electronic signature which has the same value between the parties as a handwritten signature.

Once payment has been made, a summary of the order is sent to the customer by e-mail to the e-mail address indicated by the customer. This document, which constitutes an acknowledgement of receipt, includes all the elements constituting the contract between the parties. The customer accepts that this document will be considered as proof of the contractual relationship between the parties.

In the event of a dispute concerning the reality or terms of the transaction, the computer records provided by the secure bank payment server will be considered as proof between the parties.

Any sum paid by the customer at the time of ordering does not constitute a deposit, the abandonment of which would authorize the customer to withdraw from the contract.

The benefit of a contract is personal to the customer and cannot be transferred without the agreement of CHRISTINE DARVIN.

CHRISTINE DARVIN reserves the right to cancel any order in the event of refusal to authorise payment by credit card by officially accredited organisations or in the event of non-payment.

16 - DELIVERY

Delivery is limited to mainland France (excluding Corsica, Monaco, Belgium and Luxembourg).

The order is delivered by Colissimo (excluding Corsica) to the address indicated during the order process, depending on the weight of the parcel, with signature, at no additional cost other than a contribution of €10.74 to €17.08 (including VAT) for Metropolitan France.

If the customer chooses home delivery in a letterbox without signature, the cost is €9.31 inc. VAT and €15.64 inc. VAT against signature for Metropolitan France

Or according to weight and signature by DPD Predict between 1kgs and 3kgs tariff from €7.27 to €8.46 inc. VAT

Or according to weight and signature by DPD Relais between 1kgs and 3kgs tariff from €6.70 to €7.30 inc. VAT

Sales and prices are ex 80420 Flixecourt - France. Packages are sent by post and CHRISTINE DARVIN negotiates registration fees with La Poste on the customer's behalf.

* Postage is free in mainland France for orders over €20 including VAT.

16.1 Delivery times

Delivery times take into account preparation and dispatch times, to which is added the delivery time of the carrier, La Poste.

For orders in Metropolitan France, the customer will be delivered within an average of 5 working days from order confirmation. The customer can choose between home delivery (in a letterbox without a signature or against a signature) and out-of-home delivery (cityssimo areas, post offices, local shops). For out-of-home collection, the customer will be notified by e-mail of the arrival of the parcel. An identity document will be required for collection from post offices and local shops. Packages are available for 10 working days.

These times include preparation time for orders

Our carriers do not deliver to Belgium, Luxembourg or Corsica.

16.2 Common stipulations

Delivery times take into account preparation and dispatch times, to which is added the delivery time of the carrier, La Poste.

Orders placed on the www.parfums-christinedarvin.com website on Friday afternoon, Saturday or Sunday are processed on the following Monday.

Orders placed on www.parfums-christinedarvin.com on a public holiday other than Friday afternoon, Saturday or Sunday are also processed on the next working day.

Working days on the CHRISTINE DARVIN site run from Monday 9am to Friday 11.30am.

CHRISTINE DARVIN makes every effort to deliver all products ordered within a maximum period of 15 (fifteen) days and within 3 (three) months in the case of products not immediately available in stock.

However, except in cases of force majeure, if the products ordered have not been delivered by the end of the delivery period indicated, the customer may request cancellation of the order if, after a first formal notice to deliver within a reasonable period, the products have not been delivered.

In this case, any amount collected for the undelivered order will be returned to the customer within a maximum period of 14 days following receipt by CHRISTINE DARVIN of the customer's request for return.

In any event, the customer may not protest against any delay in delivery in the event that it is not up to date with its obligations towards CHRISTINE DARVIN, particularly with regard to payment, or if CHRISTINE DARVIN was not in possession in good time of any specifications and/or information necessary for delivery.

17 - LIABILITY

All products offered for sale by CHRISTINE DARVIN on its Internet site comply with current French legislation. It is the responsibility of the customer residing outside France to ensure that the products conform to the legislation in force in the country of destination.

The Customer is solely responsible for the choice of products ordered, as well as their conservation and use.

CHRISTINE DARVIN reminds you that, in application of article 1124 of the French Civil Code, non-emancipated minors, who are incapable of contracting, are not authorized to place an order on the site. Consequently, orders intended for minors must be placed by parental authority. In the event of accidental collection of nominative data from a minor, the parental authority has the right to object to their storage and/or transaction to third parties.

Hypertext links may lead to websites other than the present one. CHRISTINE DARVIN declines all responsibility in the event that the content of these websites contravenes the legal and regulatory provisions in force.

In addition, CHRISTINE DARVIN reminds you that any creation of a hypertext link to the home page of the present site or to any other page of the site is subject to the express, prior and written agreement of CHRISTINE DARVIN.

18 - CONSUMER WARRANTY

The customer will benefit from the legal warranty for hidden defects (article 1641 to 1648 of the French Civil Code) and the legal warranty for conformity (article L 217-4 et seq. of the French Consumer Code) (see appendix 1).

Legal warranty of conformity:

If the customer acts under the legal warranty of conformity, he has a period of two years from the date of delivery of the goods to take action;

He may choose between repairing or replacing the good, subject to the cost conditions stipulated in article L. 217-9 of the French Consumer Code (if neither of these solutions is effective within one month of the date of his complaint, he may demand a refund);

The customer does not have to prove the existence of a lack of conformity for six months following delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods;

As a reminder, the legal warranty of conformity applies independently of any commercial warranty that may have been granted;

The customer may decide to invoke the warranty against hidden defects in the item sold as defined in article 1641 of the French Civil Code, in which case he or she may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the French Civil Code".

Finally, when exercising the legal guarantee of conformity, no costs may be charged to the Customer.

CHRISTINE DARVIN is a member of the FEBEA (Fédération des entreprises de la beauté) to guarantee consumer rights and compliance with the professional code.

Any dispute or claim for non-conformity must be made by sending a registered letter with acknowledgement of receipt to CHRISTINE DARVIN at the following address:

19 - WITHDRAWAL RIGHTS: MONEY-BACK GUARANTEE

In accordance with article L.221-18 et seq. of the French Consumer Code, the customer has the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the goods.

To exercise the right of withdrawal, the customer must notify Christine Darvin, Groupe Panther 20 rue Gaspard Monge, 33610 Canéjan - France.

CHRISTINE DARVIN undertakes in return to acknowledge receipt by e-mail to the customer of his withdrawal.

In the event of withdrawal by the customer, CHRISTINE DARVIN will reimburse the customer without undue delay for all payments received from the customer, including delivery costs (with the exception of additional costs arising from a delivery method other than the less expensive standard delivery method proposed by CHRISTINE DARVIN) and in any event no later than 14 days from the day on which CHRISTINE DARVIN was informed by the customer of its decision to withdraw from the contract.

CHRISTINE DARVIN may defer reimbursement until receipt of the goods or until the Customer has provided proof of shipment of the goods, whichever occurs first.

CHRISTINE DARVIN will make the refund using the same means of payment as that used by the Customer for the initial transaction, unless an exception is expressly stipulated; in any event, this refund will not incur any costs for the Customer.

The direct costs of returning the goods shall be borne by the Customer. The cost of returning the goods will be limited to the cost of postage.

The Customer may only be held liable for the depreciation of the good resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the good.

19-1 Non-satisfaction of the product

If the CHRISTINE DARVIN product does not meet the customer's expectations,

The CHRISTINE DARVIN product is returned at the customer's expense after being opened and CHRISTINE DARVIN refunds the price of the product within a maximum of 14 days

19-2 Delivery not in conformity with the order

Despite all the care taken by CHRISTINE DARVIN in the preparation of parcels, a CHRISTINE DARVIN product may be missing or there may be a product error in the delivery.

In the event of a missing product or a product error for which CHRISTINE DARVIN is responsible:

- CHRISTINE DARVIN will generate a nominative discount voucher (in the form of a credit note) to be used on its Internet site

Or

- CHRISTINE DARVIN exchanges the product(s) in the event of an error on the product(s) (depending on available stocks) within a maximum period of 14 days from receipt of the returned product

Or

- CHRISTINE DARVIN reimburses the product(s) within a maximum of 14 days from the date of receipt of the returned product

. In all cases, CHRISTINE DARVIN will pay the shipping and return costs, if any.

19.3 - Defective products

Despite all the care taken by CHRISTINE DARVIN in the preparation of packages, it is possible that a CHRISTINE DARVIN product may be damaged or defective.

If the returned product is recognised as defective by CHRISTINE DARVIN, CHRISTINE DARVIN undertakes :

- to reimburse the customer or the product(s) within a maximum period of 14 days from receipt and verification of the returned product.

Or

- exchange the defective product, subject to stock availability, within a maximum of 14 days from receipt and verification of the product. Any exchange will only be possible on the same reference of the returned product.

CHRISTINE DARVIN is responsible for any shipping and return costs, except in cases where the product taken back or exchanged does not correspond to the original declaration made by the customer. The cost of return postage will be capped at the postage rate.

19.4 - MEDIATION AND DISPUTES

In accordance with order no. 2015-1033 of August 20, 2015 and implementing decree no. 2015-1382 of October 30, 2015, any so-called consumer dispute or litigation, subject to article L.152-2 of the Consumer Code, may be settled out of court by mediation with the CMAP - Centre de Médiation et d'Arbitrage de Paris.

Prior to referring a complaint to the CMAP, the consumer must have already sent an e-mail to CHRISTINE DARVIN's Customer Service at contact@christine-darvin.com and not have obtained a response or satisfaction to his/her complaint.

To submit your dispute to the mediator, you can :

- send your request by ordinary or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or send an email to consommation@cmap.fr

Whatever the means used to refer your dispute to CMAP, your request must contain the following elements to be processed rapidly: Your postal, email and telephone contact details, as well as the full name and address of your company or the establishment concerned, a succinct statement of the facts, and proof of prior contact with our company or the establishment concerned.

20 - CONFORMITY - RECEIPT

CHRISTINE DARVIN invites the Customer to check the conformity of the products (condition, absence of defects, number, etc.) on receipt, in the presence of the carrier if applicable.

In the event of non-conformity of the product delivered, CHRISTINE DARVIN invites the Customer to express reservations on the delivery note.

The Customer is invited to contact CHRISTINE DARVIN's Customer Service within fourteen (14) working days of receipt of the products. In the event of proven and observed non-conformity, CHRISTINE DARVIN undertakes, at the Customer's option, either to exchange the product for an identical product or one of equivalent quality and price depending on stock availability, or to reimburse the Customer for the price of the product within a maximum period of 14 days following the BUYER's request. If it is impossible to replace the defective product, the Customer may demand reimbursement of the price of the order within one month of the date of the complaint.

21 - TRANSFER OF OWNERSHIP

Products are sold under reservation of ownership until full payment has been received.

In this respect, payment means effective settlement on CHRISTINE DARVIN's account of the price of the products, the costs relating to the order and interest.

Until such time, it is the customer's responsibility to allow identification of products ordered, delivered and not paid for.

22 - TRANSFER OF RISK

It is expressly agreed that, notwithstanding the reservation of title clause mentioned in article 21 above, the products are deemed to be in the customer's custody from the date of delivery as defined in article 16 above. Therefore, from the date of delivery, the customer alone shall bear the risks that the products may undergo or cause, for any reason whatsoever, even in the event of force majeure, fortuitous event or the act of a third party.

CHRISTINE DARVIN undertakes to take out insurance covering any damage caused or suffered by the product(s) ordered by the customer and not delivered from the date of full payment by the customer.

23 - APPLICABLE LAW - LITIGATION

The present terms and conditions, as well as the contracts they govern, are subject to French law.

In the event of a dispute, the French courts shall have exclusive jurisdiction.

24 - MODIFICATION OF TERMS AND CONDITIONS OF SALE :

In view of possible changes to the site, CHRISTINE DARVIN reserves the right to adapt or modify the general conditions of sale at any time. The new general terms and conditions of sale will, where applicable, be brought to the customer's attention by on-line modification and will only apply to sales made after the modification.

APPENDIX 1 (Legal warranty of conformity)

Article L211-4 Code de la consommation

The seller is obliged to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery.

He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation, when the latter is his responsibility under the contract or was carried out under his responsibility.

The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.

The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.

25 - LOYALTY REWARD - PERSONALIZED MONTHLY OFFER

As part of its loyalty program, Christine Darvin reserves the right to grant a personalized discount coupon to certain customers each month.

As such, the three customers who have made the largest amount of purchases on the www.parfums-christinedarvin.com/fr/ website during the previous month may receive a 5% discount coupon to be used on a future order.

The selection is made automatically and objectively, based on the order data recorded on the site. In the event of a tie between several customers, Christine Darvin reserves the right to draw lots.

The discount voucher is nominative, non-transferable and valid for one month from the date of issue. It cannot be combined with other current promotions, nor can it be exchanged for cash.
